Intra-Moot Court Competition highlights legal craft of Law students- A Report

Date: 18 November 2021

Every law student must understand that there are a few essential aspects of Legal study that they must know. These comprise of things like writing a research paper, taking part in various conferences and competitions, etc. Of these, a key aspect of pursuing law as a career option is the exposure to “Moot Court” and the related academic activity of “Mooting”. Mooting is basically an earnest attempt to Create, witness and take part in a court proceeding and an exercise to know the court crafts.
In a moot court, an appropriate scenario based on actual courtroom is created for the students to have a real-life experience. They have to pretend to appear and argue the matter either from petitioner or respondent side in the Moot Court. The participation in Moot Court competitions trains the law student with the required skills which is necessary in the courts of law when they start their professional Journey.

So, an Intra-Moot Court competition was organized at the University by Department of Legal Studies on 17 to 18 November 2021. Theme of the competition was ‘Euthanasia in India’. On the first day of the competition, Dr. Praveen Kumar Rathi, Head of the Department, briefed the students about the importance of Moot Court competition. Then, started the qualifying rounds in which following teams participated:

Team C: Yash, Khushi, Mukul (BBA LLB 5th & BALLB 3rd Semester)
Team D: Palak, Priya, Anil (BBA LLB 5th & BALLB 1st Semester)

All the participating teams made their arguments on the Fundamental Rights with special reference to Right to Life as provided under Article 21 of the Constitution. They argued ‘Right to life is one of the basic as well as fundamental right without which all rights cannot be enjoyed. Right to life means a human being has an essential right to live. Human being has the right not to be killed by another human being’. But the question arises, if a person has a right to live, whether he has a right not to live i.e. right to die. The petitioners as well as the respondent referred various leading case laws in the support of their arguments. Since March 2018, Passive euthanasia is legal in India under strict guidelines. Patients must consent through a living will, and must be either terminally ill or in a vegetative state.
On the basis of first day performances, Team B and D were selected to perform in the final round. On the final day i.e. on 18th Nov 2021, both the shortlisted teams presented their arguments in the moot court and evaluated by the jury members.
